PERM vs National Interest Waiver green card
PERM labor certification requires a U.S. employer to test the labor market and sponsor Form ETA-9089 before filing Form I-140. A National Interest Waiver lets you self-petition Form I-140 directly, without a job offer or labor certification, if you meet the three-part test from Matter of Dhanasar under INA § 203(b)(2)(B). NIW moves faster and survives a job change; PERM generally carries a higher overall approval rate.
What is PERM labor certification?
PERM requires a specific employer to obtain a Prevailing Wage Determination, run a minimum 30-day recruitment campaign, and file Form ETA-9089 with the Department of Labor under 20 C.F.R. Part 656. The employer must show no qualified U.S. worker is available for the position. Only after DOL certifies the labor market test can the employer file the I-140.
What is a National Interest Waiver?
An NIW is an EB-2 category (advanced degree or exceptional ability) that waives the job offer and labor certification requirement under INA § 203(b)(2)(B). USCIS applies the three-prong test from Matter of Dhanasar, 26 I&N Dec. 884 (AAO 2016): the work has substantial merit and national importance, the petitioner is well positioned to advance it, and waiving the job offer benefits the United States on balance. Because there's no sponsoring employer, you file Form I-140 yourself.
How long does each take?
PERM's Prevailing Wage Determination alone averages several months, and recruitment adds a mandatory 30 days before ETA-9089 can be filed. Per the DOL OFLC PERM Processing Times data, non-audited applications are running close to 7 months, while audited cases stretch past 20 months. Add I-140 processing after certification — 6 to 8 months at standard speed, or 15 calendar days with premium processing. An NIW skips the DOL step entirely: file the I-140 directly, with standard USCIS processing in the range reported in USCIS Immigration and Citizenship Data, FY2023, or 45 calendar days using premium processing.
What does each cost?
PERM involves mandatory recruitment advertising (commonly $300–$1,500 in print and job-board placement fees), attorney fees for the DOL filing, then the $715 USCIS fee to file Form I-140. An NIW skips recruitment costs entirely and goes straight to the $715 I-140 filing fee, plus the optional $2,805 premium processing fee if you want the 45-day USCIS decision.
What happens if you change jobs or your employer withdraws?
A PERM labor certification is tied to one employer and one job description. If the employer withdraws sponsorship before the I-140 is approved, the certification is void and the process restarts from the Prevailing Wage Determination. Once the I-140 is approved and an adjustment of status application has been pending 180 days, INA § 204(j) portability allows a move to a same or similar occupation. An NIW isn't tied to any employer, so changing jobs, becoming self-employed, or working as an independent contractor doesn't affect the petition.
What about my priority date?
Both paths use the filing date of the underlying petition (ETA-9089 for PERM, I-140 for NIW) as the priority date under 8 C.F.R. § 204.5(e). A PERM case that stalls in a DOL audit loses time the priority date can't recover; an NIW filer controls that timeline directly.
Can I self-file an NIW without a lawyer? Yes — there's no employer sponsor requirement — but the Dhanasar standard is evidentiary and subjective, and petitions lacking expert letters, citation evidence, or a clear national-importance argument are routinely denied even by qualified candidates.
Is PERM only for EB-2? No. PERM supports both EB-2 (advanced degree/exceptional ability) and EB-3 (skilled worker, professional, other worker) categories. NIW is available only within EB-2.
Can I switch from PERM to NIW mid-process? Yes, if you qualify for EB-2 on your own credentials. Many clients file an NIW while a PERM case from a separate employer is still pending, since the two can run concurrently.
What if my PERM case gets audited? DOL can audit any ETA-9089 for compliance with recruitment and wage rules. Audits typically add 12 months or more and sometimes result in denial if recruitment documentation has gaps — a risk an NIW doesn't carry since there's no DOL recruitment step.
Does an NIW guarantee approval? No. USCIS still weighs each Dhanasar prong individually, and weak national-importance arguments are the most common reason for denial.
Can I downgrade from EB-2 NIW to EB-3 PERM later? It requires a new EB-3 PERM filing and I-140 from an employer — the NIW priority date doesn't transfer unless the same underlying I-140 is amended before a final decision.
